Arrest Made For Man Wanted In Connection With Lowell Double-Homicide

LOWELL A fifth man wanted in connection with the shooting death of two brothers in Lowell has been arrested in Florida, Middlesex District Attorney Gerry Leone informed the public today.

Karon McDougal, 28, of Lowell, was arrested today by the United States Marshall Service in Tampa, Florida.  McDougal was indicted in December on charges of first degree murder and armed home invasion.

“We allege that Karon McDougal fled after participating in the fatal shooting of two beloved brothers in Lowell,” District Attorney Leone said.  “I commend the United States Marshall Service for their diligent, collaborative work in apprehending this wanted and dangerous man.”

McDougal is expected to be rendited to Massachusetts where he will be arraigned on the murder charges.

McDougal’s co-defendants, Joshua Silva, 23, of Lowell, Ariel Hernandez, 21, of Lowell, Timothy Brown, 21, of Lowell, and Jamal McDougal, 26, of Lowell, were arraigned on December 22 in Middlesex Superior Court on charges of murder in the first degree (2 counts) and armed home invasion.  Jamal McDougal, Hernandez, and Brown were also arraigned on charges of possession of a firearm and possession of ammunition.  All were ordered held without bail.

The trial date is scheduled for January 3, 2011.

According to authorities, at approximately 1:30 a.m. on October 23, 2009, Lowell Police responded to reports of shots fired at 7 Marshall Terrace in Lowell

Upon arrival, authorities located two men suffering from apparent gun shot wounds.  The victims were transported to the hospital where they died shortly after.  The victims are identified as Luis Delgado, 34, of Lowell and Hector Delgado, 37, of Lowell.  Lowell Police and State Police assigned to the Middlesex District Attorney’s Office conducted an immediate investigation into the circumstances of the victims' deaths.

Based on that investigation, it is alleged that the victims were shot during an intended armed home invasion and robbery at the victims' residence.  Witness accounts, cell phone records, ballistics, and forensic evidence obtained by investigators identified the five defendants as being responsible for shooting Luis and Hector Delgado.

Silva was arrested and arraigned on December 16 in Lowell District Court and ordered held without bail.

Hernandez and Brown were arrested on December 16 and arraigned on December 17 in Lowell District Court, where they were ordered held without bail.

Jamal McDougal was arrested on December 23 and arraigned in Lowell District Court and ordered held without bail.

These charges are allegations and the defendant is presumed innocent until proven guilty.

The Assistant District Attorney is Cara Krysil.  The Victim Witness Advocate is Dora Quiroz.
