Two Men Arrested, Arraigned In Connection With Fatal Motor Vehicle Crash In Framingham

 

            FRAMINGHAM- September 15, 2010 — Two men have been arrested and arraigned on OUI charges in connection with a motor vehicle crash that resulted in the death of a highway construction worker, Middlesex District Attorney Gerry Leone and Framingham Police Chief Steven Carl informed the public today.

            Jeremy Gardner, 29, of Bridgton, Maine, was arraigned on charges of operating under the influence, second offense, motor vehicle homicide, leaving the scene of a motor vehicle crash, and operating to endanger. Framingham District Court Judge Paul Healy, Jr. held the defendant on $100,000 cash bail with the conditions that he refrains from the use of alcohol, does not drive, and is subject to random drug and alcohol screenings.

             Walter Smith, 49, of Barre, Vermont, was arraigned on a charge of operating under the influence, third offense. He was ordered held on $50,000 cash bail with the conditions that he refrains from the use of alcohol, does not drive, and is subject to random drug and alcohol screenings.

             Their next court date is October 13 for a pretrial conference.

             According to authorities, at approximately 10:45pm last night, Massachusetts State Highway employees were working on a construction project on Route 9 at Crossing Boulevard when a truck drove into the construction site, striking a worker. The victim, who has been identified as Gregory Vilidnitsky, 57, was pronounced dead at the scene.

             It is alleged that Gardner was operating the truck when it struck the victim.  

             The circumstances of the crash remain under investigation by the Framingham Police Department, Massachusetts State Police, and the Middlesex District Attorney’s Office.

             These charges are allegations, and the defendants are presumed innocent until proven guilty.

The prosecutor who arraigned the defendants was David Clayton.  The prosecutor assigned to this case is Jennifer Snook.  The victim witness advocate is Kristen D’Agnelli.
