East Boston Man Arraigned On Third OUI Charges After Hitting Trooper

  

            CAMBRIDGE– July 7, 2010 — An East Boston man has been arraigned on OUI charges in connection with hitting a State Police Trooper with his car, Middlesex District Attorney Gerry Leone informed the public today.

 

            Felix Morales, 39, of East Boston, was arraigned today in Cambridge District Court on charges of OUI, 3rd offense, OUI causing serious bodily injury, and negligent operation of a motor vehicle.  Cambridge District Court Judge Roanne Sragow ordered bail set at $10,000 bail, which the defendant had posted, and with the conditions that he sustain from alcohol, sustain from driving, and surrender his driver’s license.

 

            His next court date is August 5 for a pre-trial hearing.

           

            According to authorities, on July 5 at approximately 12:30am, Massachusetts State Police responded to a report of a Trooper struck by a motor vehicle at the intersection of O’Brien Highway and Land Boulevard in Cambridge.  The victim had been directing traffic at the intersection along with two other Troopers for the 4th of July festivities.

 

            Upon further investigation, it is alleged that the defendant was operating a white Nissan Maxima in a left turn only lane when he failed to stop as instructed and, instead, drove straight into the victim.  The victim suffered from three impacts, the first being the victim’s legs hitting the hood and bumper of the vehicle, the second being the impact with the hood of the vehicle and the third being the impact with the ground as he was ejected from the hood when the vehicle stopped.

 

            The victim was transported to Mass General Hospital, where he was treated for his injuries.  The defendant was placed under arrest and failed subsequent sobriety tests, including a breathalyzer test where he registered a .15%.

 

            These charges are allegations and the defendant is presumed innocent until proven guilty.

 

            The prosecutor who arraigned the defendant was Assistant District Attorney Evelyn Tang.  The prosecutor assigned to the case is Assistant District Attorney Samir Zaganjori.
