DCR Lifeguard Arraigned On Child Pornography Charges

 

MALDEN – A DCR lifeguard has been arraigned on child pornography charges, Middlesex District Attorney Gerry Leone informed the public today.

 

Anthony Gabriella, 19, of Malden, was arraigned in Malden District Court on charges of possession of child pornography (2 counts) and possession with the intent to disseminate child pornography.  Malden District Court Judge Maurice Flynn set bail at $2,500 with the conditions that the defendant not use computers or the Internet, have no unsupervised contact with children, and that he cease working at the pool where he was a lifeguard.

 

His next court date is August 25 for a pre-trial hearing.

 

            “The charges against the defendant are troubling, compounded by the fact that the defendant has direct exposure and access to young children through his position as a lifeguard,” District Attorney Leone said.  “We continue to aggressively investigate and prosecute cyber crime, focusing on offenders that target vulnerable children.”

 

On June 1, 2010, Massachusetts State Police Detectives assigned to the Middlesex District Attorney’s Office, who are members of the Massachusetts Internet Crimes Against Children (ICAC) Task Force, conducted an investigation into the use of file sharing programs for the possession and distribution of child pornographic images and movies.  During the investigation, investigators observed a computer reporting that it was sharing suspected child pornography files.  Investigators were able to connect to the host computer and obtained a list of over 200 files with names of what appeared to be child pornography.

 

At approximately 5:30 pm last night, a search warrant was executed at the defendant’s home, where the suspected computer was registered.  A laptop and two thumb drives were confiscated from the defendant’s bedroom. An onsite preview of the computer confirmed that the defendant was storing at least 250 child pornographic videos and images in multiple folders.

           

The defendant was arrested at his home and transported to the Massachusetts State Police Barracks in Medford.

 

            These charges are allegations, and a defendant is presumed innocent until proven guilty.
