Boston Man Indicted For Threats, Stalking Probate Judge

WOBURN – July 8, 2010 — A Boston man has been indicted for threats, stalking, and related charges in connection with the ongoing harassment of a Middlesex Probate Judge, Middlesex District Attorney Gerry Leone informed the public today.

Jay Korff, 54, of Boston, was indicted by a Suffolk Superior Court Grand Jury on charges of stalking (2 counts), threats (3 counts), annoying phone calls (4 counts) and unauthorized access of a computer.

Korff was indicted in Suffolk County due to the fact that as the investigation into the crimes the defendant is alleged to have committed continued, it was discovered that many of the crimes originated in Suffolk.  The Middlesex DA’s office retained jurisdiction over the investigation and the resulting indictments.

Korff will be arraigned on July 23 in Suffolk Superior Court.

“This defendant is alleged to have harassed and threatened the victim for over 3 years causing the victim and his family anguish and anxiety over an extended period of time.” District Attorney Leone said.  “The defendant’s actions were deliberate and calculated attempts at targeting the core of our judicial system.”

According to authorities, the defendant was a litigant in a divorce case before the victim approximately six years ago.  The victim ruled in the case and the defendant subsequently appealed the ruling.  The case was eventually settled out of Court.

In March 2007, the victim had difficulty accessing his email due to his password being changed without his knowledge.  Sometime after this unauthorized access of his computer, several different people from the victim’s address book received e-mails linking to derogatory comments about the victim.

In August 2009, the victim received three bizarre phone messages, and his daughter also received emails that were derogatory about the victim during this time.

In October 2009 through March 2010, the victim received numerous alarming text and voice mail messages to his cell phone and to his wife’s phone.  Throughout this time period, the victim and his family also received numerous hang-up calls.

An investigation revealed that the phone number tracked to many of the alarming and threatening voice and text messages, as well as the hang-ups, was from the same AT&T TracFone prepaid cell phone.

On March 19, 2010, a search warrant was executed at the defendant’s apartment.  The defendant’s computer was seized and the serial number for the Tracfone was located on it as well as several audio files that matched the voicemails the victim received.  Additionally, a file with all of the victim and his wife’s phone numbers and a file with pictures of the Judge and his family were found.

These charges are allegations, and the defendant is presumed innocent until proven guilty.

This case was investigated by State Police assigned to the Middlesex District Attorney’s Office.

The prosecutor assigned to this case is Middlesex Assistant District Attorney Alice Casey with assistance from Middlesex Assistant District Attorney Lisa Sulborski.  The Victim Witness Advocate is Rebecca Auld.
