Wilmington Man Sentenced To 12-15 Years In Prison On Child Rape Charges

Assaults Occurred In Burlington

 

WOBURNA Wilmington man has been sentenced after a jury found him guilty of rape of a child with force and assault with intent to rape a child, Middlesex District Attorney Gerry Leone informed the public today.

 

Herbert Dorazio, 51, of Wilmington, was found guilty by a Middlesex Superior Court Jury on July 30 on charges of rape of a child with force and assault with intent to rape a child.  Today, Middlesex Superior Court Judge Thomas Billings sentenced the defendant to 12 to 15 years in state prison followed by 10 years probation from and after with the conditions that he has no contact with the victims, the victims’ families and any witnesses, no unsupervised contact with children under the age of 16, must attend and complete sex offender treatment, maintain employment, register as a sex offender and comply with the Sex Offender Registration Board, provide a DNA sample and remain on GPS monitoring. 

 

            According to authorities, this defendant lived in a neighborhood where the families and children socialized at each other’s homes. The defendant would often prefer to play with the children, particularly at his own home. 

 

            During one of the neighborhood gatherings when the neighborhood children were playing at his house, the defendant created an opportunity to be alone with the first victim in his backyard.  It was during this time that the defendant first sexually assaulted the victim. A second similar assault on this victim took place within two weeks of the first assault.

 

            The defendant also knew the second victim from neighborhood gatherings. On one afternoon, the defendant asked the second victim to accompany him inside his house to get something from the basement. Once the two were downstairs alone, the defendant sexually assaulted the second victim.

 

            Both victims were 6 years old at the time of the assaults.

 

            The defendant was indicted by a Middlesex Grand Jury on February 12, 2009. He was arraigned on March 13, 2009 and was released on personal recognizance with the conditions that he comply with GPS monitor device, no contact with victims, their families and witnesses, no unsupervised contact with children under the age of 16, abide by all Probate Court orders, no employment where there are children under the age of 16, report to the police for booking and report to Probation as directed.

 

            The prosecutor assigned to this case is Assistant District Attorney Patrick Fitzgerald.  The victim witness advocate is Susan Marshall.  The Child Interview Specialist is Katie Nugent.
